WELCOME TO MINI NINJA

Mini Ninja is a space designed for safe, active play, exploration and fun for little Ninjas aged 0–7.

Our team takes every care to create a safe and enjoyable environment. However, like any active play space, participation may involve small risks such as slips, trips, bumps or loss of balance.

IMPORTANT INFORMATION

This agreement contains important information about participation and safety.

By signing, you acknowledge that:

• You understand the nature of the activities and the associated risks
• You accept those risks on behalf of yourself and the child/children in your care
• You agree to the terms set out below

This clause is highlighted in accordance with Section 49 of the Consumer Protection Act.

1. DEFINITIONS

• “Mini Ninja” means Mini Ninja Winelands (Pty) Ltd, including its directors, employees, contractors, agents and representatives
• “Participant” means any person entering or using the play areas, including children and accompanying adults
• “Child/Children” refers to participants aged 0–7
• “Parent/Guardian” means the parent, legal guardian or authorised adult acting in loco parentis
• “Activities” include all play areas, soft play, obstacle elements and related facilities

2. ACKNOWLEDGEMENT & ASSUMPTION OF RISK

I understand that active play involves natural movement and interaction, which may include slips, trips, bumps, collisions or loss of balance.

• I acknowledge and agree that:
• These risks are inherent and cannot be completely eliminated
• Participation takes place at my own risk and/or that of the child/children in my care
• I voluntarily allow participation and accept these risks
• This agreement applies to all areas of Mini Ninja, including entry, exit, waiting areas and surrounding premises

3. SUPERVISION & RESPONSIBILITY

I understand and agree that:

• Mini Ninja is a parent-supervised environment and not a childcare facility
• I am responsible for the supervision, behaviour and safety of the child/children in my care at all times
• Staff monitor the environment but do not supervise individual children
• Any adult entering the play area is considered a Participant and does so at their own risk
• Children under 4 years must be accompanied within the play area at all times by a participating adult (18+)

I further agree to:

• Actively supervise and assist where needed
• Ensure equipment is used safely and as intended
• Follow all rules, signage and staff instructions

4. SHARED PLAY ENVIRONMENT

• I understand that Mini Ninja is a shared environment and that interaction with other participants forms part of the experience.
• I accept that the behaviour of others cannot be fully controlled and forms part of the inherent risks of participation.

5. RELEASE OF LIABILITY

To the fullest extent permitted by South African law:

I, on behalf of myself and the child/children in my care, release and hold harmless Mini Ninja from liability for any injury, loss or damage arising from participation in the Activities, except where caused by gross negligence or unlawful conduct.

6. INDEMNITY

I agree to indemnify and hold harmless Mini Ninja and its representatives from any claims, damages or costs arising from:

• Participation by myself or the child/children in my care
• Injury or damage caused by myself or the child/children in my care
• Failure to supervise appropriately
• Any breach of this agreement

7. HEALTH & MEDICAL CONSENT

I confirm that I and the child/children in my care are fit to participate and have no condition that makes participation unsafe.

I authorise Mini Ninja to administer first aid and arrange emergency medical treatment if required, and I accept responsibility for any associated costs.

8. ALLERGIES & SENSITIVITIES

• I understand that Mini Ninja is a shared play environment and, while reasonable care is taken to maintain a clean and safe space, it is not possible to guarantee a completely allergen-free environment.
• I acknowledge that exposure to allergens (including food, materials, cleaning products or contact with other participants) may occur.
• I confirm that I am responsible for managing any known allergies or sensitivities for myself and/or the child/children in my care.
• To the fullest extent permitted by law, Mini Ninja cannot be held liable for allergic reactions or related adverse effects, except where caused by gross negligence or unlawful conduct.

9. SAFETY RULES

I agree that I and the child/children in my care will:

• Follow all safety rules and staff instructions
• Use equipment only as intended
• Wear Mini Ninja grip socks where required

I acknowledge that failure to follow safety requirements may increase the risk of injury.

I further understand that:

• Children under 4 must be accompanied within the play area at all times by a participating adult (18+)
• Accompanying adults are Participants and are required to pay entry fees and wear Mini Ninja grip socks
• Non-compliance may result in refusal of entry or removal without refund

10. PHOTOGRAPHY, CCTV & DATA (POPIA)

I acknowledge and agree that:

• CCTV operates for safety and security
• Photos/videos may be taken for operational and marketing purposes
• Personal information will be collected and processed for bookings, safety and operations

Mini Ninja will handle all personal information in accordance with POPIA and will not sell personal data.

I consent to receiving operational communications and occasional marketing, with the option to opt out at any time.

11. GOVERNING LAW

This agreement is governed by the laws of the Republic of South Africa.

12. DECLARATION & AUTHORITY

I confirm that:

• I am authorised to act for the child/children in my care (in loco parentis)
• I have authority to agree to this waiver on their behalf
• I have read, understood and agree to these terms

13. CONTINUING VALIDITY

This agreement applies to all future visits unless revoked in writing.

14. SEVERABILITY

If any part of this agreement is found to be invalid or unenforcable, the remaining provisions will remain in full force.
